I. General Terms and Conditions

§ 1 Scope of application

(1) These General Terms and Conditions (GTC) apply to all contracts that you, as a consumer or entrepreneur, conclude with us as the provider via the website www.laduti.de. Deviating terms and conditions of the customer are not recognised unless we expressly agree to their validity in writing.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity.

§ 2 Subject matter and conclusion of contract

(1) The subject matter of the contract is the sale of goods, in particular cosmetic products.

(2) By placing the respective product in our online store, we make you a binding offer to conclude a purchase contract under the conditions specified in the item description.

(3) The contract is concluded via the online shopping cart system: The goods intended for purchase are placed in the "shopping cart". You can call up the "shopping cart" at any time and make changes using the corresponding button in the navigation bar. After calling up the "Checkout" page and entering your personal data as well as the payment and shipping conditions, all order data will be displayed again. By clicking on the "Buy now" button, you declare your legally binding acceptance of the offer.

(4) Alternatively, you can also send us an individual request (e.g. by e-mail). In this case, you will receive a binding offer from us, which you can accept within five days.

§ 3 Right of withdrawal for consumers

The statutory right of withdrawal applies in accordance with our withdrawal policy. Please note in particular that the right of withdrawal for sealed cosmetic products expires as soon as the seal has been removed after delivery or the product has been opened (§ 312g para. 2 no. 3 BGB).

§ 4 Prices, shipping costs and terms of payment

(1) The prices stated in the offers are final prices and include all price components including taxes.

(2) Additional shipping costs incurred will be shown separately in the order process. For orders from Switzerland, the customer is responsible for any customs duties and import taxes.

(3) The available payment methods are shown in the online store. Unless otherwise agreed, payments are due immediately upon conclusion of the contract.

§ 5 Delivery and shipping conditions

(1) The delivery conditions (delivery time, shipping method, restrictions if applicable) are specified in the store.

(2) In the case of consumers, the risk of accidental loss or accidental deterioration of the goods shall only pass to the customer upon delivery.

(3) Orders will only be delivered to the delivery areas specified in the store.

§ 6 Retention of title

The goods remain our property until payment has been made in full.

§ 7 Warranty

The statutory warranty rights apply. As a consumer, you are requested to check the goods upon delivery for completeness, obvious defects and transport damage and to notify us immediately of any complaints. If you fail to do so, this has no effect on your statutory warranty claims.

§ 8 Liability

(1) We shall be liable without limitation for damages resulting from injury to life, body or health, as well as in all cases of intent and gross negligence, fraudulent concealment of defects, assumption of a guarantee or if liability is mandatory by law.

(2) In the event of slight negligence, we shall only be liable for the breach of essential contractual obligations (so-called "cardinal obligations"). In this case, liability shall be limited to the foreseeable damage typical for the contract.

(3) Liability for slightly negligent breach of insignificant contractual obligations is excluded.

(4) Data transmission via the Internet cannot be guaranteed to be error-free according to the state of the art. In this respect, we are not liable for the constant or uninterrupted availability of the website or for technical faults that are beyond our control.

§ 9 Choice of law, place of performance and jurisdiction

(1) German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In the case of consumers, this choice of law shall only apply insofar as it does not restrict mandatory statutory provisions of the country in which the consumer has his habitual residence.

(2) The place of performance is our registered office if you are an entrepreneur.

(3) The place of jurisdiction is also our registered office if you are a merchant, a legal entity under public law or a special fund under public law.

(1) The contract language is German.
(2) The contract text is not permanently stored by us. Before sending the order, you can print out the contract data using the print function of your browser or save it electronically. After sending the order, you will receive an e-mail with the order data and our General Terms and Conditions.

5. Prices and terms of payment

(1) All prices include taxes and duties. (2) Shipping costs are shown separately. (3) Customers in Switzerland are additionally liable for any customs duties and import taxes. (4) The available payment methods can be found in the order process.

(1) Delivery time, shipping methods and delivery restrictions are specified in the store. (2) The risk of accidental loss shall not pass to consumers until the goods are handed over to the customer.
